新浪財(cái)經(jīng)訊 朱燕翎女士是中國(guó)狀告雀巢第一人，她今年4月將瑞士雀巢公司及上海雀巢告上法庭，后撤回對(duì)總公司起訴。這是中國(guó)第一起消費(fèi)者狀告食品生產(chǎn)商因沒(méi)有標(biāo)注轉(zhuǎn)基因食品，侵犯知情權(quán)的案件。以下為朱燕翎女士致雀巢公司的公開信（英文，后附中文譯文），內(nèi)容如下： ：

　　Dear Sir/Madam,

　　As you are aware, Nestle’s history in China has been a successful one. Nestle is the one of the earliest foreign food producers to enter the Chinese market. For many Chinese consumers, Nestle is synonymous with coffee. This is just one example of the huge popularity of the Nestle brand in China.

　　Being a Chinese consumer, I grew up with Nestle products. During my studies in Switzerland, I was fortunate enough to be given a visit of Nestle’s headquarters in Vevey by a friend of mine. The visit left a good impression on me, and it increased my trust in Nestle’s products. After I gave birth to my child three years ago, I chose to buy Nestle’s products for my baby without any hesitation. Because of my fondness for and trust in Nestle’s products, I am also very concerned with Nestle’s development in China.

　　However, one day, I was shocked to learn from the Internet that Nestle’s Nesquik contains genetically engineered (GE) ingredients! After I confirmed that Nestle’s Nesquik does contain GE ingredients that are not properly labeled, shock turned to anger. I have been unknowingly feeding my baby with GE food!

　　I am angry because Nestle has not been truthful. This is disrespectful to Chinese consumers. I decided to initiate a court case against Nestle. The damage compensation I am demanding is small, but I believe Chinese consumers have the right to know and choose what they are buying for their families.

　　As far as I know, Nestle has pledged publicly to stop using GE ingredients in many European countries, especially in baby food products. In subsequent communications between Nestle and my lawyer, Nestle failed to provide satisfactory explanations for its“double standard”: why is a globally famous baby food producer adopting different policies in different parts of the world? Why is Nestle ignoring consumers’right to know by not labeling its GE products?

　　As an ordinary consumer and mother of a son, I sincerely hope Nestle can give me an answer. I demand (1) Nestle to adopt the same policy in China as in European countries, that is, to eliminate GE ingredients from its products and (2) to pay full respect to consumers’right to informed choice by properly labeling its GE products.

　　I am making these demands because there are millions of mothers in the world who trust Nestle to provide their kids with nutritious food. Please do not abuse the trust of these mothers and their children!

　　身為一名中國(guó)消費(fèi)者，我的成長(zhǎng)過(guò)程中總有雀巢產(chǎn)品相伴。在瑞士留學(xué)期間，我曾經(jīng)榮幸的應(yīng)邀參觀了位于瑞士維維城的雀巢總部。這次參觀給我留下了很好的印象，也增加了我對(duì)雀巢產(chǎn)品的信賴。三年前我有了自己的小孩，我毫不猶豫的為他選擇了雀巢食品。源于我對(duì)雀巢產(chǎn)品的熱愛(ài)和信賴，我也一直很關(guān)注雀巢在中國(guó)的發(fā)展。

　　然而有一天，我非常震驚的在網(wǎng)上發(fā)現(xiàn)雀巢“巧伴伴”食品含有轉(zhuǎn)基因成分！當(dāng)我確認(rèn)雀巢“巧伴伴”的確含有轉(zhuǎn)基因成分并且沒(méi)有在包裝上明確標(biāo)注時(shí)，震驚變?yōu)榱藨嵟�。我在不知情的情況下竟然給我的孩子食用了轉(zhuǎn)基因食品！

　　我憤怒是因?yàn)槿赋驳牟徽\(chéng)實(shí)。這是對(duì)中國(guó)消費(fèi)者的不尊重。我決定對(duì)雀巢提起法律訴訟。我要求的損害賠償額是很小的，但是我堅(jiān)信中國(guó)消費(fèi)者有權(quán)利知道他們?yōu)樽约旱募彝ベ?gòu)買的是什么樣的產(chǎn)品。

　　據(jù)我所知，雀巢在歐洲公開表示停止銷售含有轉(zhuǎn)基因成分的產(chǎn)品，尤其是在嬰兒食品市場(chǎng)。在后來(lái)雀巢與我律師的溝通中，雀巢未能就它的“雙重標(biāo)準(zhǔn)”給出一個(gè)合理的解釋：為什么一家全球馳名的嬰兒食品生產(chǎn)商在世界的不同地區(qū)采用不同的政策？為什么雀巢不明確標(biāo)注它的轉(zhuǎn)基因食品而不顧消費(fèi)者的知情權(quán)？

　　作為一名普通消費(fèi)者，作為一個(gè)孩子的母親，我真誠(chéng)希望雀巢能給我一個(gè)答案。我要求：第一，雀巢在中國(guó)應(yīng)采用同在歐洲國(guó)家一樣的標(biāo)準(zhǔn)，即去除產(chǎn)品中的轉(zhuǎn)基因成分；第二，正確標(biāo)示它的轉(zhuǎn)基因產(chǎn)品，給予消費(fèi)者充分的知情權(quán)和選擇權(quán)。

　　我提出這些要求是因?yàn)槿�世界有�?shù)以百萬(wàn)計(jì)的母親相信雀巢能夠?yàn)樗齻兊暮⒆犹峁�營(yíng)養(yǎng)食品。請(qǐng)不要罔顧這些母親和孩子的信任！
