  中國(guó)國(guó)際經(jīng)濟(jì)貿(mào)易仲裁委員會(huì)(英文縮寫CIETAC,同時(shí)稱中國(guó)國(guó)際商會(huì)仲裁院,以下簡(jiǎn)稱貿(mào)仲委)是附設(shè)在中國(guó)國(guó)際商會(huì)/中國(guó)國(guó)際貿(mào)易促進(jìn)委員會(huì)下以仲裁的方式解決契約性和非契約性爭(zhēng)議的常設(shè)仲裁機(jī)構(gòu)。1954年經(jīng)中央人民政府政務(wù)院批準(zhǔn),于1956年在北京設(shè)立,當(dāng)時(shí)是中國(guó)唯一受理涉外商事爭(zhēng)議的仲裁機(jī)構(gòu)。1987年,中國(guó)成為聯(lián)合國(guó)《承認(rèn)與執(zhí)行外國(guó)仲裁裁決公約》締約國(guó),中國(guó)政府這一重大舉措極大地促進(jìn)了中國(guó)涉外仲裁的發(fā)展,使中國(guó)涉外仲裁登上了國(guó)際商事仲裁的大舞臺(tái)。在中國(guó)市場(chǎng)經(jīng)濟(jì)發(fā)展初期和對(duì)外開放不斷深入的經(jīng)濟(jì)環(huán)

境下,貿(mào)仲委肩負(fù)著促進(jìn)對(duì)外貿(mào)易發(fā)展,吸引、鼓勵(lì)、保護(hù)外商到中國(guó)投資,解決對(duì)外貿(mào)易糾紛的重任,是對(duì)外開放的重要的法律服務(wù)窗口,仲裁業(yè)務(wù)發(fā)展迅速,國(guó)際地位日益提高,國(guó)際影響與日俱增,并逐步成為國(guó)際上知名的仲裁機(jī)構(gòu)之一。

  貿(mào)仲委五十年的仲裁實(shí)踐積累了豐富的經(jīng)驗(yàn),并不斷地完善前進(jìn),日益現(xiàn)代化、國(guó)際化。從1990年起,貿(mào)仲委年受案量在世界知名仲裁機(jī)構(gòu)中名列前茅。在1995年仲裁法實(shí)施前,中國(guó)所有的涉外經(jīng)貿(mào)仲裁案件均由貿(mào)仲委受理,仲裁法頒布后,絕大多數(shù)的涉外案件仍然由當(dāng)事人提交貿(mào)仲委審理并裁決。2000年貿(mào)仲委修訂了仲裁規(guī)則,開始受理國(guó)內(nèi)經(jīng)貿(mào)爭(zhēng)議,國(guó)內(nèi)仲裁案件增幅較大。到2003年為止,貿(mào)仲委已經(jīng)成功地受理并審結(jié)了8000余例涉外仲裁案件,近千件國(guó)內(nèi)仲裁案件。案件當(dāng)事人遍及世界40多個(gè)國(guó)家和地區(qū),仲裁裁決可在世界140多個(gè)國(guó)家和地區(qū)得到承認(rèn)和執(zhí)行,仲裁的公正性得到了普遍認(rèn)可。

  1.貿(mào)仲委機(jī)構(gòu)設(shè)置和職能

  貿(mào)仲委在組織機(jī)構(gòu)上實(shí)行委員會(huì)制度,設(shè)主任一人,副主任若干人,委員若干人;秘書長(zhǎng)一人,副秘書長(zhǎng)若干人。主任履行仲裁規(guī)則賦予的職責(zé),副主任受主任的委托可以履行主任的職責(zé)。貿(mào)仲委現(xiàn)任主任由中國(guó)國(guó)際商會(huì)會(huì)長(zhǎng)、中國(guó)國(guó)際貿(mào)易促進(jìn)委員會(huì)會(huì)長(zhǎng)萬季飛兼任,秘書長(zhǎng)由王生長(zhǎng)博士擔(dān)任,秘書長(zhǎng)負(fù)責(zé)處理仲裁委員會(huì)的日常事務(wù)。

  貿(mào)仲委下設(shè)三個(gè)專門委員會(huì):專家咨詢委員會(huì)負(fù)責(zé)仲裁程序和實(shí)體上的重大疑難問題的研究和提供咨詢意見;案例編輯委員會(huì)負(fù)責(zé)已審理終結(jié)案件的案例編輯工作;資格審查考核委員會(huì)負(fù)責(zé)對(duì)仲裁員的資格和表現(xiàn)進(jìn)行審查和考核,提出續(xù)聘和解聘的建議。

  貿(mào)仲委總會(huì)設(shè)在北京,在上海和深圳設(shè)立了兩個(gè)分會(huì),總會(huì)與分會(huì)設(shè)立統(tǒng)一的仲裁員名冊(cè),使用統(tǒng)一的仲裁規(guī)則。貿(mào)仲委北京總會(huì)和深圳分會(huì)、上海分會(huì)是一個(gè)統(tǒng)一的整體。

  貿(mào)仲委設(shè)立域名爭(zhēng)議解決中心和亞洲域名爭(zhēng)議解決中心,負(fù)責(zé)解決各種域名爭(zhēng)議。

  貿(mào)仲委與中國(guó)糧食行業(yè)協(xié)會(huì)、貿(mào)促會(huì)糧食行業(yè)分會(huì)聯(lián)合成立了糧食爭(zhēng)議仲裁中心,以仲裁的方式解決糧食行業(yè)發(fā)生的一切爭(zhēng)議。

  貿(mào)仲委在當(dāng)?shù)刭Q(mào)促分會(huì)內(nèi)附設(shè)了大連、長(zhǎng)沙、重慶、成都、福州等五個(gè)辦事處,在貿(mào)促會(huì)北京市分會(huì)內(nèi)附設(shè)了聯(lián)絡(luò)處,各辦事處和聯(lián)絡(luò)處均是貿(mào)仲委的仲裁專業(yè)聯(lián)絡(luò)和宣傳機(jī)構(gòu),向當(dāng)事人提供仲裁宣傳、程序咨詢、轉(zhuǎn)交仲裁申請(qǐng)書等服務(wù)。

  2.仲裁規(guī)則

  2000年10月1日,貿(mào)仲委頒布實(shí)施了第六套《仲裁規(guī)則》,該仲裁規(guī)則分為“總則”、“仲裁程序”、“簡(jiǎn)易程序”、“國(guó)內(nèi)仲裁的特別規(guī)定”和“附則”五章共91條。爭(zhēng)議金額超過人民幣50萬元的案件適用普通程序;爭(zhēng)議金額不超過人民幣50萬元的案件適用簡(jiǎn)易程序。但是雙方另有約定的,應(yīng)按約定適用普通程序或簡(jiǎn)易程序。

  當(dāng)事人約定適用其他仲裁規(guī)則的,可以適用。但須經(jīng)貿(mào)仲委同意。

  2003年5月8日,貿(mào)仲委頒布實(shí)施了《金融爭(zhēng)議仲裁規(guī)則》,該規(guī)則分為“總則”、“仲裁程序”、“裁決”和“附則”四章28條。規(guī)則規(guī)定,雙方當(dāng)事人可以約定由一名或三名仲裁員組成仲裁庭;在仲裁過程中,仲裁庭可以發(fā)布程序令、發(fā)出問題單、舉行庭審前會(huì)議、召開預(yù)備庭等;作出裁決的期限在仲裁庭組成之日起45個(gè)工作日內(nèi),除非當(dāng)事人另有約定或本案確有正當(dāng)理由延期外。適用《金融爭(zhēng)議仲裁規(guī)則》的案件,其仲裁費(fèi)比普通仲裁案件的仲裁費(fèi)降低了50%左右。

  中國(guó)(.CN)域名爭(zhēng)議適用《中國(guó)互聯(lián)網(wǎng)信息中心域名爭(zhēng)議解決辦法》、《中國(guó)互聯(lián)網(wǎng)信息中心域名爭(zhēng)議解決辦法程序規(guī)則》及其《補(bǔ)充規(guī)則》;通用網(wǎng)址(Keyword)爭(zhēng)議適用《通用網(wǎng)址爭(zhēng)議解決辦法》和《通用網(wǎng)址爭(zhēng)議解決程序規(guī)則》;通用頂級(jí)域名(gTLDs)爭(zhēng)議適用《統(tǒng)一域名爭(zhēng)議解決解決政策》、《統(tǒng)一域名爭(zhēng)議解決政策之規(guī)則》及其《補(bǔ)充規(guī)則》。

  3.貿(mào)仲委業(yè)務(wù)范圍

  根據(jù)《中國(guó)國(guó)際經(jīng)濟(jì)貿(mào)易仲裁委員會(huì)仲裁規(guī)則》第二條的規(guī)定,貿(mào)仲委受案范圍是:

  (一)國(guó)際的或涉外的爭(zhēng)議;

  (二)涉及香港特別行政區(qū)、澳門特別行政區(qū)或臺(tái)灣地區(qū)的爭(zhēng)議;

  (三)外商投資企業(yè)相互之間以及外商投資企業(yè)與中國(guó)其他法人、自然人及/或經(jīng)濟(jì)組織之間的爭(zhēng)議;

  (四)涉及中國(guó)法人、自然人及/或其他經(jīng)濟(jì)組織利用外國(guó)的、國(guó)際組織的或香港特別行政區(qū)、澳門特別行政區(qū)、臺(tái)灣地區(qū)的資金、技術(shù)或服務(wù)進(jìn)行項(xiàng)目融資、招標(biāo)投標(biāo)、工程建筑等活動(dòng)的爭(zhēng)議;

  (五)中華人民共和國(guó)法律、行政法規(guī)特別規(guī)定或特別授權(quán)由仲裁委員會(huì)受理的爭(zhēng)議;

  (六)當(dāng)事人協(xié)議由仲裁委員會(huì)仲裁的其它國(guó)內(nèi)爭(zhēng)議。

  上述仲裁規(guī)則將原來只受理涉外經(jīng)貿(mào)爭(zhēng)議調(diào)整為國(guó)內(nèi)外經(jīng)貿(mào)爭(zhēng)議,擴(kuò)大了貿(mào)仲在國(guó)內(nèi)的服務(wù)領(lǐng)域,得到了國(guó)內(nèi)企業(yè)界的廣泛歡迎。

  根據(jù)《中國(guó)國(guó)際經(jīng)濟(jì)貿(mào)易仲裁委員會(huì)金融爭(zhēng)議仲裁規(guī)則》第二條的規(guī)定,貿(mào)仲委受理金融爭(zhēng)議的范圍是:當(dāng)事人之間因金融交易發(fā)生的或與此有關(guān)的爭(zhēng)議均可以提交貿(mào)仲委仲裁。規(guī)則所指金融交易,是指金融機(jī)構(gòu)之間以及金融機(jī)構(gòu)與其他法人和自然人之間在貨幣市場(chǎng)、資本市場(chǎng)、外匯市場(chǎng)、黃金市場(chǎng)和保險(xiǎn)市場(chǎng)上所發(fā)生的本外幣資金融通、本外幣各項(xiàng)金融工具和單據(jù)的轉(zhuǎn)讓、買賣等金融交易,包括但不限于下列交易:1、貸款;2、存單;3、擔(dān)保;4、信用證;5、票據(jù);6、基金交易和基金托管;7、債券;8、托收和外匯匯款;9、保理;10、銀行間的償付約定。

  域名爭(zhēng)議解決中心,經(jīng)中國(guó)互聯(lián)網(wǎng)絡(luò)信息中心(CNNIC)的授權(quán),解決中文域名爭(zhēng)議、通用網(wǎng)址爭(zhēng)議、.CN域名爭(zhēng)議。此外,域名爭(zhēng)議解決中心還作為國(guó)際通用頂級(jí)域名(gTLDs)管理機(jī)構(gòu)美國(guó)互聯(lián)網(wǎng)絡(luò)名稱和數(shù)碼分配公司( ICANN)授權(quán)的國(guó)際通用頂級(jí)域名爭(zhēng)議解決機(jī)構(gòu)—亞洲域名爭(zhēng)議解決中心之北京秘書處,負(fù)責(zé)解決國(guó)際通用頂級(jí)域名爭(zhēng)議。

  4.仲裁員

  貿(mào)仲委實(shí)行仲裁員名冊(cè)制度,當(dāng)事人應(yīng)在《仲裁員名冊(cè)》中指定仲裁員。仲裁員均是從法律、經(jīng)濟(jì)貿(mào)易、科學(xué)技術(shù)等方面具有專門知識(shí)和實(shí)際經(jīng)驗(yàn)的中外人士中聘任的。

  貿(mào)仲委《涉外仲裁員名冊(cè)》擁有仲裁員550名,其中外籍仲裁員183名,適用涉外仲裁案件的當(dāng)事人選定仲裁員。國(guó)內(nèi)案件一方當(dāng)事人是外商投資企業(yè)的,也可以在該名冊(cè)中選定外籍仲裁員擔(dān)任;《國(guó)內(nèi)仲裁員名冊(cè)》擁有仲裁員368名,適用國(guó)內(nèi)案件當(dāng)事人選定仲裁員;《金融專業(yè)仲裁員名冊(cè)》仲裁員90名,適用金融案件當(dāng)事人選定仲裁員;貿(mào)仲委還將在近期出臺(tái)《建設(shè)工程與房地產(chǎn)專業(yè)仲裁員名冊(cè)》、《糧食行業(yè)爭(zhēng)議仲裁員名冊(cè)》、《證券爭(zhēng)議仲裁員名冊(cè)》和《期貨爭(zhēng)議仲裁員名冊(cè)》。貿(mào)仲委實(shí)行的仲裁員名冊(cè)制度為當(dāng)事人提供了一支公正高效的專業(yè)仲裁員隊(duì)伍。

  為了加強(qiáng)仲裁員職業(yè)道德規(guī)范,貿(mào)仲委頒布了《聘任仲裁員規(guī)定》、《仲裁員守則》、《仲裁員行為考察規(guī)定》和《仲裁員異議通報(bào)制度》,對(duì)仲裁員在審理案件過程中的行為實(shí)施監(jiān)督,對(duì)不合格的仲裁員堅(jiān)決予以解聘,采取各種措施保證仲裁員廉潔高效地仲裁案件。

  5.仲裁協(xié)議

  貿(mào)仲委根據(jù)當(dāng)事人之間達(dá)成的仲裁協(xié)議和一方當(dāng)事人的書面申請(qǐng),受理仲裁案件。按照《仲裁法》的規(guī)定,有效的仲裁協(xié)議應(yīng)當(dāng)具有下列內(nèi)容:(1)請(qǐng)求仲裁的意思表示;(2)仲裁事項(xiàng);(3)選定的仲裁委員會(huì)。當(dāng)事人在仲裁協(xié)議中可以約定適用普通仲裁程序還是簡(jiǎn)易仲裁程序,仲裁員人數(shù)、國(guó)籍,開庭地點(diǎn),仲裁地點(diǎn),適用法律,及仲裁語文等事項(xiàng)。

  Brief Introduction to CIETAC

  China International Economic and Trade Arbitration Commission (CIETAC in brief and hereinafter referred to as the Arbitration Commission, also named as the Court of Arbitration of China Chamber of International Commerce) is a standing arbitral organization to settle contractual and non-contractual disputes by means of arbitration under the guidance of China Chamber of International Commerce/ China Council for the Promotion of International Trade. The commission was approved by Government Administration council of the Central People’s Government of the People’s Republic of China in 1954 and established in Beijing in 1956 which was the only arbitration organization accepting foreign commercial disputes at that time. In 1987, China became a contracting party of Treaty of Acceptance and Performance of Foreign Arbitrament of the United Nations. This important act of China’s government has largely fostered the development of China’s foreign arbitration, integrating China’s foreign arbitrationotniinternational commercial arbitration. At the early period of the development of China’s market economy and under the economic circumstances of furthering of openness, CIETAC takes on promoting foreign trade, attract, encourage, protect foreign investment and settle disputes concerning foreign trade that is an important window of legal service for openness. And with rapid development of arbitration, increasing improvement of international status and growing influence in the world, it has become one of the well-known arbitral organizations in the world.

  CIETAC has accumulated rich experience during 50 years of arbitration practice, continuously making progress with increasing modernization and internationalization. It has ranked ahead among famous arbitration organizations all over the world in terms of number of acceptance of cases since 1990. Before the Arbitration Law cameotniforce in 1995, all cases concerning foreign commercial arbitration were accepted by CIETAC and, after the issue of the law, most of the foreign cases has been still advanced by the parties to CIETAC for arbitrament. In 2000, the Arbitration Commission amended the rules of arbitration; setting out to accept internal commercial disputes, so there has been big increase in internal arbitration case. Until 2003, the Arbitration Commission has accepted and settled over 8000 foreign arbitration cases and almost 1000 internal arbitration cases, the parties of which cover over 40 countries and areas all over the world. The arbitrament of the Arbitration Commission can be accepted and performed in over 140 countries and areas in the world whose justice has been generally recognized.

  Structure and Functions of the Arbitration Commission

  CIETAC operates under the system of forming a commission, which is composed of one Chairman, several Vice-Chairmen and a number of members. There are a Secretary-General and several Vice Secretaries-General. The Chairman performs the functions and duties vested in him by the Arbitration Rules and the Vice-Chairmen may perform the Chairman’s functions and duties with the Chairman’s authorization. Wan Jifei, chairman of China Chamber of International Commerce/ China Council for the Promotion of International Trade, holds a post as chairman of the Arbitration Commission. Doctor Wang Shengchang holds a post as Secretary-General who is in charge of the day-to-day works of the Arbitration Commission.

  CIETAC establishes three special committees. Expert Advisory Committee is in charge of research of key difficult problems in arbitration procedure and entity and providing advice. Case Editing Committee is in charge of editing settled cases. Qualification Assessment Committee is in charge of examination and assessment of qualification and performance, offering suggestions on extending and firing.

  CIETAC has its headquarters in Beijing. The Shenzhen Sub-Commission and Shanghai Sub-Commission were established respectively. They use the same Arbitration Rules and Panel of Arbitrators. The Beijing Headquarters of the Arbitration Commission and its Shenzhen Sub-Commission and its Shanghai Sub-Commission are one institution.

  CIETAC establishes dispute settlement center of domain name and Asia dispute settlement center of domain center in charge of disputes concerning all sorts of domain name.

  Food Dispute Arbitration Center is founded by CIETAC in combination with China Foodstuff Associate and Foodstuff Sub-commission of CIETAC aimed to resolve all disputes in foodstuff industry by means of arbitration.

  CIETAC established five offices respectively in Dalian, Fuzhou, Changsha, Chongqing and Chengdu within local sub-commissions and a liaison office in Beijing Sub-commission all of which are professional arbitration liaison and promotion organizations of CIETAC, providing parties with such services as promotion of arbitration, consultation about procedure and delivering arbitration application.

  The Arbitration Rules were adopted by China Chamber of International Commerce and took effect on Oct 1, 2000. Arbitration Rules of the Arbitration Commission contains 91 articles in five Chapters, i.e.“General Provisions”,“Arbitration Proceedings”,“Summary Procedure”,“Special Provisions for Domestic Arbitration”and“Supplementary Provisions”. The Summary Procedure shall apply to any case in disputeerehwthe amount of the claim totals not more that RMB 500,000 yuan. Any caseerehwthe amount in dispute totals more than RMB 500,000 yuan shall be handled under the Ordinary Procedure. Provided that two parties otherwise have agreement, any case should be handled under Summary Procedure or Ordinary Procedure.

  Parties have agreed to apply other arbitration rules, which can be in use with agreement of CIETAC.

  In May 8th of 2003, Arbitration Rules Concerning Disputes in Finance was issued by CIETAC and took effect which contains 28 articles in four chapters,i.e.“General Provision”,“Arbitration Proceedings”,“Arbitrament”and“Supplementary Provisions”. In accordance with the rules, the parties shall agree to establish arbitration court composed of one or three arbitrators. In the course of arbitration, this court issue procedure act and questionnaire and hold pre-jurisdiction meeting and preliminary court and so on. Arbitrament shall be made within 45 working days since the day of establishing court unless the parties otherwise have agreements or it is really reasonable for the case to be extended. The fee for any case applying to Arbitration Rules Concerning Disputes in Finance is lower by about 50% than that of ordinary arbitration cases.

  Disputes concerning China’s Domain Name apply to“Solutions to Disputes Concerning Domain Name of China Internet Information Center”,“Procedure Rules of Solutions to Disputes Concerning Domain Name of China Internet Information Center and“Supplementary Rules”. General Keyword applies to“Solutions to Disputes concerning General Keyword”and“Procedure Rules of Solutions to Disputes concerning General Keyword”. Disputes concerning gTLDs apply to“Solutions to Disputes concerning General Domain Name”,“Rules of Solutions to Disputes concerning General Domain Name”and“Supplementary Rules”.

  Scope of Accepting Cases

  According to second article of“Arbitration Rules of CIETAC”, CIETAC takes cognizance of cases relating to the disputes:

  (1) international or foreign-related disputes ;

  (2) disputes related to the Hong Kong SAR, Macao SAR or Taiwan regions;

  (3) disputes between the enterprises with foreign investment and disputes between an enterprise with foreign investment and another Chinese legal person, physical person and/or economic organization;

  (4) disputes arising from project financing, invitation for tender, bidding, construction and other activities conducted by Chinese legal persons, physical persons and/or other economic organizations through utilizing the capital, technology or service from foreign countries, international organizations or from the Hong Kong SAR, Macao SAR and Taiwan regions; and/or other economic organizations through utilizing the capital, technology or service from foreign countries, international organizations or from the Hong Kong SAR, Macao SAR and Taiwan regions;

  (5) disputes that may be taken cognizance of by the Arbitration Commission in accordance with special provisions of or upon special authorization from the law or administrative regulations of the people’s Republic of China, and;

  (6) other domestic disputes parties agree to arbitrated by the Arbitration Commission

  The above rules of arbitration extends CIETAC’s scope of accepting cases from original foreign commercial disputesotniinternal commercial disputes, expanding service in mainland, which is extensively welcomed by enterprise circle in China.

  In line with second article of“Arbitration Rules of Finance Disputes of CIETAC”, scope of accepting financial disputes of CIETAC includes: disputes arising from financial transactions or disputes concerned shall be submitted by the parties to CIETAC for arbitration. Financial transaction referred in rules is such transactions as financing of one’s own country’s money and foreign money, transference and transaction of all types of financial tools and documents concerning one’s own country’s money and foreign money between financial institutions or between financial institutions and other legal entities and natural persons in money market, capital market, exchange market, gold market and insurance market. These transactions include but are not limited to the following ones: 1. loaning 2.depositing receipt 3. confirming 4. letter of credit 5. documents 6. fund transaction and trust 7. bond 8. collection and remittance of foreign exchange 9. assurance management 10. reimbursement agreement between banks.

  Dispute Settlement Center of Domain Name is authorized by CNNIC to resolve disputes concerning Chinese domain name, Keywords and CN domain name. In addition, this center serves as Beijing secretary of Asia Dispute Settlement Center of Domain Name, dispute settlement organization concerning gTLDs authorized by ICANN, management institution of gTLDs, which is in charge of solve disputes concerning gTLDs.

  Arbitrator

  The Arbitration Commission applies arbitrator personage system. The arbitrators are selected and appointed from Arbitrator Book with special knowledge and practical experience in trade and economics, science and technology, law and other fields at home and abroad.

  Arbitrator in Foreign Affairs Book of CIETAC has 550 arbitrators including 183 foreign arbitrators whom parties in foreign arbitration cases can appoint. Provided that one of the parties in internal case is foreign-funded companies can select and appoint foreign arbitrators in this book. And Internal Arbitrator Book has 386 arbitrators whom the parties in internal case can select and appoint. Finance Professional Arbitrator Book had 90 arbitrators whom the parties in financial case can select and appoint. Recently CIETAC will issue Arbitrator of Construction and Real Estate Book, Arbitrator in Foodstuff Disputes Book, Arbitrator in Security Disputes Book and Arbitrator in Future Disputes Book. Arbitrator book system in CIETAC will provide the parties with a team of fair and high-efficient professional arbitrators.

  In pursuant to strengthen the ethical regulations of arbitrators, CIETAC has issued Regulations of Hiring Arbitrators, Rules of Arbitrators, Regulations concerning Assessment of Arbitrators’Behavior and Notification System of Disagreement on Arbitrators to supervise arbitrator during the course of cognizance, insist on firing unqualified arbitrators and take all kinds of measures to ensure arbitrators to settle cases with probity and efficiency.

  Arbitration Agreement

  CIETAC takes cognizance of a case in accordance with an arbitration agreement between the parties to refer their dispute to CIETAC for arbitration and upon the written application by one of the parties.

  According to the Arbitration Law, a valid arbitration agreement must contain the following contents: (1) the intention to submit the dispute for arbitration, (2) affair for arbitration, (3) appointed arbitration committee. The parties may choose to stipulate in their arbitration clause (arbitration agreement) the number and nationality of arbitrators, the venue of the hearing, the application of Ordinary Procedure or Summary Procedure, the applicable law, the language of arbitration and etc.

  CIETAC enjoys a wide reputation domestically and internationally for its independence, impartiality, efficiency and expeditiousness in handling cases during fifty years of arbitration practice and keeps friend cooperation with other international arbitration organizations. CIETAC has signed agreement on arbitration cooperation with over 20 international famous arbitration organizations in succession. CIETAC is devoted to expand its influence on international law circles and commercial circles and continue to introduce arbitration products in line with market needs, providing the parties with high-quality service with heart.
